Property loss claims involving insured power plant equipment failures increasingly give rise to coverage and subrogation issues relating to underlying goods and/or services warranties and capacity penalty claims. These issues have become more prevalent and more complex over the past several years, particularly impacting large market losses. This presentation will address the potential and actual impacts on coverage and recovery of insured claims for losses which implicate equipment manufacturer and service provider warranties and capacity/non-performance penalty claims, as well as the best approaches for addressing and resolving these issues.
